Environmental Impact Assessment (AMDAL)

To meet the permitting process, business operators are required to conduct an AMDAL if the location of their activity falls under the AMDAL criteria, including:

  1. Alteration of landforms and landscapes.
  2. Exploitation of natural resources, both renewable and non-renewable.
  3. Processes and activities that may potentially cause pollution and/or environmental damage, as well as waste and depletion of natural resources.
  4. Processes and activities that may affect the natural environment, the built environment, and socio-cultural environments.
  5. Processes and activities that may impact the conservation of natural resource areas and/or the protection of cultural heritage sites.
  6. Introduction of new plant species and microorganisms.
  7. Production and use of biological and non-biological materials.
  8. Activities with high risks and/or those that affect national defense.
  9. Application of technologies that are expected to have a significant potential impact on the environment.

These criteria can be found in the annex of the Minister of Environment and Forestry Regulation No. 4 of 2021, which outlines the required AMDAL based on the scale of the area and the risk associated with each KBLI (Indonesian Business Classification Code).

When preparing AMDAL documents, business operators are required to collaborate with authorized professional consultants. The documents to be prepared include:

  • Terms of Reference (KA)
  • Environmental Impact Analysis (ANDAL)
  • Environmental Management Plan (RKL) and Environmental Monitoring Plan (RPL)

Legal Basis:
According to Government Regulation No. 22 of 2021 on the Implementation of Environmental Protection and Management, AMDAL is defined as a study that assesses the significant impacts that a proposed business and/or activity may have on the environment. This study is a key requirement in the business licensing or approval process from the central or regional government.

Who is required to conduct an AMDAL?
Business activities in an area that fall under the 9 AMDAL criteria and are subject to the AMDAL requirements outlined in Minister of Environment and Forestry Regulation No. 4 of 2021.

Businesses operating without an AMDAL will be subject to DELH (Environmental Impact Evaluation Document), which will first result in a sanction notice. There is a fine that must be paid based on the administrative penalty for not having environmental documents (DLH), as stated in Article 514, paragraph (1) of Government Regulation No. 22 of 2021. This sanction is imposed on the business responsible for operating without Environmental Approval.

DELH stands for Environmental Impact Evaluation Document, which contains environmental management and monitoring plans as part of an environmental audit process. This document is imposed on businesses and/or activities that are already operational and have business permits but have significant environmental impacts. In other words, DELH is designated for businesses and/or activities that are already running but do not yet have an AMDAL document.

Analisis Dampak Lingkungan (AMDAL)

Dalam memenuhi proses perizinan, pelaku usaha harus menjadi wajib amdal jika lokasi kegiatan masuk dalam kriteria amdal:

  1. Pengubahan bentuk lahan dan bentang alam.
  2. Eksploitasi sumber daya alam, baik yang terbarukan maupun yang tidak terbarukan.
  3. Proses dan kegiatan yang secara potensial dapat menimbulkan pencemaran dan/atau kerusakan lingkungan hidup, serta pemborosan dan kemerosotan sumber daya alam dalam pemanfaatannya.
  4. Proses dan kegiatan yang hasilnya dapat mempengaruhi lingkungan alam, lingkungan buatan, serta lingkungan sosial dan budaya.
  5. Proses dan kegiatan yang hasilnya akan mempengaruhi pelestarian kawasan konservasi sumber daya alam dan/atau perlindungan cagar budaya.
  6. Introduksi jenis tumbuh-tumbuhan, dan jasad renik.
  7. Pembuatan dan penggunaan bahan hayati dan nonhayati.
  8. Kegiatan yang mempunyai risiko tinggi dan/atau mempengaruhi pertahanan negara.
  9. Penerapan teknologi yang diperkirakan mempunyai potensi besar untuk mempengaruhi lingkungan hidup.

Dan dapat dilihat pada lampiran Permen LHK no. 4 tahun 2021 yang menampilkan wajib amdal berdasarkan skala luas hamparan dan resiko tiap-tiap nomor KBLI. Dalam hal penyusunan dokumen AMDAL tersebut, pelaku usaha diwajibkan untuk bekerja sama dengan konsultan profesional yang berwenang.

Dokumen yang disusun meliputi Formulir Kerangka Acuan (KA), Analisis Dampak Lingkungan (ANDAL), serta Rencana Pengelolaan Lingkungan dan Rencana Pemantauan Lingkungan (RKL-RPL).

Landasan Hukum: Berdasarkan Peraturan Pemerintah Nomor 22 Tahun 2021 tentang Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup, AMDAL didefinisikan sebagai studi mengenai dampak penting yang mungkin ditimbulkan suatu rencana usaha dan/atau kegiatan terhadap lingkungan hidup. Kajian ini menjadi salah satu syarat utama dalam proses perizinan berusaha atau persetujuan dari pemerintah pusat maupun daerah.

Usaha terbangun tanpa amdal akan terkena DELH yang didalamnya akan terkena surat sanksi terlebih dahulu. Ada besaran denda yang harus dipenuhi berdasarkan Dasar denda administratif untuk tidak memiliki dokumen lingkungan hidup (DLH) adalah Pasal 514 ayat (1) Peraturan Pemerintah Nomor 22 Tahun 2021. Sanksi ini diterapkan kepada penanggung jawab usaha yang tidak memiliki Persetujuan Lingkungan. DELH dengan kepanjangan Dokumen Evaluasi Lingkungan Hidup merupakan dokumen yang memuat pengelolaan dan pemantauan lingkungan hidup yang merupakan bagian dari proses audit lingkungan hidup yang dikenakan bagi usaha dan/atau kegiatan yang sudah berjalan serta telah memiliki izin usaha dan/atau kegiatan yang berdampak penting bagi lingkungan hidup. Dengan kata lain, dokumen DELH diperuntukan bagi usaha dan/atau keguatan yang telah berjalan tetapi belum memiliki dokumen AMDAL.
